A court has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to face human smuggling allegations, he was detained in immigration detention.

In her order, the court pointed out that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
